What?
Public Act 103-0635 went into effect on January 1, 2025. The nonprofit board diversity reporting act requires nonprofits that provide $1 million or more in grants each year to make public the aggregated diversity of their Boards of Directors (by race, ethnicity, gender, disability status, veteran status, sexual orientation, and gender identity).

Why?
Equality Illinois’ support of this act was impulsed by the concern about the inequity of funding provided to the LGBTQ+ community. According to the Equitable Giving Lab, LGBTQ+ organizations receive only 0.16% of charitable giving nationwide.
Benefits for all marginalized populations. In essence, diversity on foundation boards encourages a more comprehensive and equitable approach to philanthropy, driving more intentional giving to various populations that have historically been underserved.
Demographic data collection is crucial for understanding the impact of philanthropic resources and for assessing the extent to which philanthropic resources are advancing equity (Center for Effective Philanthropy (CEP), 2022).
How? (Reporting)
- As of January 1st, 2025 when the law went into effect, aggregated data must be published on the nonprofit’s website no later than 30 days after the filing of the organization’s AG990-IL.
- Privacy is protected. The law only requires data to be reported in the aggregate. No individual director will have their demographic data published; all directors will be given the option to opt out of self-disclosing their demographic information to their nonprofit.
- The Illinois Department of Human Rights’ information site is in development. The demographics that need to be reported will likely follow those collected for the Governor’s Boards & Commissions members:
